You might. Just so you know I am not a complete bozo, I am a 3d year law student in the top ten percent at IU Bloomington. I am not familiar with Michigan employment law; it probably is an at-will employment state and you are correct, you have no 1st Am. protection. What you might have however is a species of contractual claim based on your employer's normal termination procedure. Employees who are terminated for one big thing (at least what is perceived as a big thing) compared to a series of small things (amounting generally to incompetence) are often fired without the normal warning/probation... sort of procedures. In several states, employee handbooks and even unpublished but routinely followed policies are considered to be part of the employment contract and employers are therefore bound by such policies. If your employer had a normal termination policy and failed to follow it in your case, this may (I stress MAY) create a cause of action for breach of contract. Again I am not familiar with Michigan law, nor have I been admitted to the bar (can't practice law yet), so I cannot advise you any further, but if you have yet to contact an attorney, I would at least make a phone call or two just to be sure.

If your past employer hasn't awakened to the facts of reality in current day life, you're much better off living in an open employment market. I'm 72 years of age and, even at this time of life, have come to realize thatwe no longer live in horse and buggy days and must accept the fact that sexual comments and individual tastes dominate the Internet as well as television.
